The UGC section of BON Cloud is an integrated international platform. It acquires Chinese content from the public and offers multi-service media solutions for the content. It offers only hosting service for the Work uploaded but not paid streaming or downloading services. BON Cloud pays a fee for the Work adopted and thus owns the right to further adapt and/or process the Work. BON Cloud firmly opposes any violation of the Copyright Law of the People's Republic of China and related regulations. Where any violation is discovered, BON Cloud will immediately remove the violating content and shall immediately stop the transmission of such content, whether pirated, illegally reproduced, or uploaded, or through any other means of infringement. Moreover, BON Cloud has drawn up the measures below to protect the Intellectual Property of proper rights owners:
If you are the copyright owner and/or a legal licensee of a work, according to the Regulation on Protection of the Right to Network Dissemination of Information, in accordance with the “Copyright Law of the People’s Republic of China”, and you wish to claim that the User of BON UGC section has infringed upon your rights in accordance with this regulation, please do inform BON Cloud in writing. You shall be responsible for the authenticity of the written notification.
Except widely known works, for example, famous film & TV works, and other obvious violations, the accuser shall provide the following materials:
1. Identification of the copyright owner, including but not limited to ID card, Business License for Enterprise’s Legal Person, and the Business Registration Certificate, etc.
2. Copyright ownership certificates. Copyright Registration Certificate or licensing agreement which proves your ownership of the copyright of the work that has been allegedly infringed upon, in accordance with the Regulation on Protection of the Right to Network Dissemination of Information.
3. Infringement Statement, including the title and the network address of the alleged infringed work on BON Cloud (In order to address the case in good time, please provide the network address instead of the search address of the work.)
4. Your phone number, fax number, and email address.
As long as the materials are provided properly as requested, BON Cloud will take certain measures including removing the Work in accordance with the law, and inform the user who published the Work on BON Cloud. If the materials are not provided as requested, BON Cloud will not take such measures as removing the content, but other measures will be considered if the user has previously agreed to and accepted the terms of the BON Cloud Service Agreement and how the materials provided operate.
BON Cloud is not legally responsible for any infringement occurred on BON Cloud by others. The User who uploaded the alleged infringing work takes full responsibility for the infringement. BON Cloud has marked the information of the User in relative pages. If BON Cloud takes certain measures including removing the content, in accordance with the preceding paragraphs, BON Cloud shall not bear any liability for breach of contract, or any other legal responsibility to the User. If the User is acquitted of the accusation after the content has been removed, or dealt with by other measures, BON Cloud shall not be liable to pay indemnity to the User.
